1) Jasmine Newswires (Pvt) Ltd text news cannot be forwarded to third parties and is grounds for termination of your service without liability to Jasmine Newswires.

2) The transmission of information through telecommunications channels is unpredictable in nature and depends on, amongst other issues, (i) third party telecommunications operators and (ii) the proper maintenance of your receiving equipment. Jasmine Newswires gives no guarantee of the continued availability, quality of reception of the Services and speed of delivery.

3) You will receive Jasmine Newswires text news from a source identified as JNW News on Mobitel, News Alert & Sanit JNW on Tigo. Jasmine Newswires is not responsible for and cannot guarantee authenticity of any mobile text news containing reference to Jasmine Newswires or “JNW” delivered to you from any other number. You will be informed of any changes to our delivery number with notice posted on our website.

Subscription Agreement to Jasmine Newswires (Pvt) Ltd, a text news service for mobile phones (the “Services”).

1. Agreement: By subscribing to the services you acknowledge that you have read and understood and that you agree to and accept the following terms and conditions.

2. Service Provider: The Services and the JNW content are offered to you in the English language, and at a later date in Sinhala and Tamil as well, by Jasmine Newswires (Pvt) Ltd, whose registered office is at 19/1 Indra Mawatha Kalubowila Colombo Sri Lanka.

3. Registration Fees: You should be aware that your network provider may charge you for access to its connection services; you are responsible for these costs and the costs of any other third party associated with receiving the Services.

4. Start Date of Services: Your subscription to the Services commences on the date your subscripion is confimed by Jasmine Newswires. You will receive Jasmine Newswires text news from a source identified as JNW News on Mobitel, News Alert & Sanit JNW on Tigo. Jasmine Newswires is not responsible for and cannot guarantee the authenticity of any text news delivered to you from any other number. If the delivery number is changed at some point in time, you will be informed of the change and a notification posted on the website www.jnw.lk/www.jasminenews.com.

5. Cancellation: You may cancel your subscription at anytime.

6. Property rights. Jasmine Newswires text news cannot be forwarded to third parties unless with the permission of Jasmine Newswires. Forwarding of messages is grounds for termination of the service without any liability to Jasmine Newswires. If messages are forwarded with the permission of Jasmine Newswires, the letters JNW must remain on the text.
Failure to keep the letters in the text is grounds for termination of service. As between you and Jasmine Newswires, Jasmine Newswires is the holder of all the rights relating to the Services, and in particular all the intellectual property rights, in particular copyright and database rights, relating to the Content transmitted while the Services are being provided.
You may not reproduce, copy, store, transmit, communicate to the public, download or amend in any way the Content, Jasmine Newswires or other logo, images, sounds, or trade marks or any other item constituting the Services without obtaining prior consent from Jasmine Newswires in writing.

7. Alteration to the Services: Termination: Jasmine Newswires may amend all or part of the Services at any time. You acknowledge that Jasmine Newswires can withdraw any information, data or content forming a portion of the Services, or cease providing the Services entirely and terminate this Agreement at any time giving 14 days of notice.

8. Unpredictable nature of the Services. The transmission of information through telecommunications channels is unpredictable in nature and depends on, amongst other issues, (i) third party telecommunications operators and (ii) the proper maintenance of your receiving equipment. Jasmine Newswires gives no guarantee of the continued availability, quality of reception of the Services and speed of delivery.

9. Information: you acknowledge that the Content provided is on an as is basis and that you are strongly advised to check the accuracy of the Content before relying on it for any purpose whatsoever. Jasmine Newswires cannot be held liable for losses resulting from any decision taken on the basis of the Content. Jasmine Newswires does not guarantee any result arising from a decision of any kind taken on the basis of content transmitted by Jasmine Newswires.

10. Interruption of the Services. The Services may be interrupted, in whole or in part, in a case of force majeure (being events outside the control of either you or Jasmine Newswires) or during periods of maintenance. Jasmine Newswires and/or Jasmine Newswire’s designated representative(s) cannot be held liable for any damage caused directly or indirectly by the
interruption of all or part of the Services in the case of force majeure, nor loss of profits, contracts, reputation, nor for any consequential loss of any kind. For the avoidance of doubt, Jasmine Newswires does not exclude its liability for death or personal injury caused from its negligence.

11. Non-transferable rights. The rights to use the Services are personal to you, and you may not transfer or assign to a third party any of your rights and obligations as defined in this Agreement or any other document constituting this agreement.

12. Law applicable. This Agreement is governed by the laws of Sri Lanka and Jasmine Newswires and you hereby submit to the exclusive jurisdiction of the courts of Sri Lanka.

13. Generally 50-90 text messages will be sent per month for Key Alerts and 60-110 messages for Close Watch, however, due to the nature of breaking news there may be more or less alerts sent in any given month.

14. Maximum liability. In any event, our maximum liability will be the amount of any fees paid by you in the year in which event causing the liability arose.

15. Changes to Terms. We may change these Terms on reasonable notice to you. This will be done by posting a notice on the Service and material changes will also be sent to you by email. If the changes are detrimental to you, you may end the Service by giving notice to us.
